Athlo LLC (“We” or “Us”) understands that privacy and personal information are extremely important to You (any “User” as defined in the Terms of Use) and We take great care to protect them. You have the ability to control what information other Users and Your friends on Athlo.com (“The Site”) see.
This Privacy Policy (“Policy”) is designed to help You understand how We collect and use the personal information You decide to share, and help You make informed decisions when using The Site.
By using or accessing The Site, You are accepting the practices described in this Policy.
Information We Collect
When You visit The Site You provide Us with two types of information: 1) personal information You knowingly choose to disclose that is collected by Us and 2) information collected by Us as You interact with The Site.
When You register with The Site, You provide Us with the following personal information: Your name, email address, birth date, gender, and zip code.
When You enter The Site, We collect Your browser type and IP address. This information is gathered for all visitors. In addition, We store certain information from Your browser using “cookies.” A cookie is a piece of data stored on the User’s computer tied to information about the User. We use session ID cookies to confirm that Users are logged in. These cookies terminate once the User closes the browser. By default, We use a persistent cookie that stores Your login ID (but not Your password) to make it easier for You to login when You come back to The Site. When You use The Site, You may set up Your personal profile, form relationships, send messages, perform searches and queries, form groups, set up events and transmit information through various channels. You also plan and log personal and social athletic activities. We collect this information so that We can provide You the service and offer personalized features. In most cases, We collect this information to know which of The Site features and functionality are most utilized and which areas should be improved.
You post User Content (as defined in Terms of Use) on The Site at Your own risk. Although We allow You to set privacy options that limit access to Your profile, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other Users with whom You may choose to share Your profile or information. Therefore, We cannot and do not guarantee that User Content You post on The Site will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on The Site. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages or if other Users have copied or stored Your User Content.
Any improper collection or misuse of information provided on The Site is a violation of the Terms of Use and should be reported.
If You choose to use the invitation service to tell a friend about The Site, We will ask You for information needed to send the invitation, such as Your friend’s email address. We will automatically send Your friend an email or instant message inviting him or her to visit The Site. We store this information to send this invitation, to register a friend connection if Your invitation is accepted, and to track the success of The Site referral program. Your friend may contact Us to request that We remove this information from The Site database.
By using The Site, You are consenting to have the aforementioned types of personal data transferred to and processed in the United States.
Use of Collected Information
When You register with The Site You create Your own profile and privacy settings. Your profile information, as well as Your name, email and photo, are displayed to people in the networks specified in Your privacy settings to enable You to connect with people on The Site. We may occasionally use Your name and email address to send You notifications regarding new services offered by The Site that We think You may find valuable.
We may share with Third Parties certain pieces of aggregated, non-personal information, such as the number of Users who searched for a particular term, for example, or how many Users clicked on a particular advertisement. Such information does not identify You individually. We also provide aggregate information to Third Party clubs or groups about the activities of their members. An example would be Us telling a local triathlon club how many miles on average their members ran last month with no names or personal information associated with the data.
Sharing Your Information with Third Parties
We do not provide contact information to Third Party marketers without Your permission. We share Your information with Third Parties only in limited circumstances where We believe such sharing is 1) legally required or, 2) permitted by you.
We may be required to disclose User information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until We have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, We may share account or other information when We believe it is necessary to comply with law, to protect Athlo LLC interests or property, to prevent fraud or other illegal activity perpetrated through The Site service or using the Athlo name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.
Information Security
We take appropriate security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of The Site data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where We store personal data.
We restrict access to personal information to employees, contractors and agents who need to know that information in order to operate, develop or improve services provided by The Site. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.
Data Integrity
We process personal information only for the purposes for which it was collected and in accordance with this Policy or any applicable service-specific privacy notice. We review data collection, storage and processing practices to ensure that We only collect, store and process the personal information needed to provide or improve services from Us. We take reasonable steps to ensure that the personal information We process is accurate, complete, and current, but We depend on Users to update or correct their personal information whenever necessary.
Changes To This Policy
Please note that this Policy may change from time to time. We will not reduce Your rights under this Policy without Your explicit consent, and We expect most such changes will be minor. Non-material changes and clarifications will take effect immediately, and material changes will take effect within 30 days of their posting on The Site. If We make changes, We will post them and will indicate at the top of this page the Policy’s new effective date. If We make material changes to this Policy, We will notify You here, by email, or through notice on The Site home page.
